Terms of Service

The short version

  • Branly measures how AI assistants talk about your brand, tells you what to fix, and, when you approve, makes the change on your website.
  • Nothing changes on your site without your approval, and you can remove our access at any time.
  • AI assistants are run by other companies. We cannot control what they say, so we cannot promise any particular result.
  • Your data stays yours. We use it only to provide the service.

1. About these terms

These terms are an agreement between you and [BrightSense Tech Private Limited] ("Branly", "we", "us"), a company registered in India with its office at [registered address]. They cover the Branly website and product. By creating an account or using Branly, you accept these terms. If you use Branly for a company, you confirm that you are allowed to accept these terms on its behalf.

2. The service

Branly asks AI assistants, such as ChatGPT, Google AI Overviews, Google AI Mode, Gemini, Perplexity and Claude, the questions your customers ask. It measures how often your brand is named, where it ranks and what is said about it. It recommends changes and, with your approval, makes those changes on your website. We may improve or change features over time. If we remove something important you rely on, we will tell you in advance.

You can start a free trial without a card. It lasts [X days] and may include [any limits on the trial]. At the end of the trial, your account [pauses / moves to the free plan] unless you choose a paid plan. We may end or change free trials at any time.

This is the part of Branly that acts on your behalf, so we set it out carefully.

7. What we can and cannot promise

AI assistants are built and run by other companies. They change often, and the same question can get different answers. Our measurements are estimates, and we show how sure we are about each one. We work to give you accurate readings and useful recommendations, but we cannot promise that any change will get your brand named, move it up, or increase your sales.

We do not use tricks to game AI assistants, and you agree not to ask us to.

9. Your data and ours

Your data, your website and its content remain yours. You let us use them only to provide and improve Branly for you. We may use data that is combined and anonymised, so that it cannot identify you or your brand, to improve our methods. Our Privacy Policy explains how we handle personal data.

Branly's software, design, methods and brand belong to us. You may use your reports freely inside your business.

10. Confidentiality

Each of us will keep the other's non-public business information confidential, and use it only for this service.

11. Liability

We provide Branly with reasonable care and skill. Beyond that, to the extent the law allows, we are not responsible for indirect losses, such as lost profits or lost business, or for what AI assistants say. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim [or ₹X for free accounts]. Nothing in these terms limits liability that the law does not allow us to limit.

You agree to cover us for losses caused by content you give us, or by access to a website that you were not entitled to give.

12. Suspending or ending the service

You can close your account at any time. We may suspend or close an account that breaks these terms, after warning you where we reasonably can. When an account closes, you can ask us for a copy of your data within [X days]. After that we delete it, as set out in our Privacy Policy.

If we change these terms, we will update the date at the top. If a change is important, we will tell you by email at least [X days] before it takes effect.

14. Law and disputes

These terms are governed by the laws of India. Any dispute will be handled by the courts in [city, for example Gurugram or New Delhi]. [Optional: arbitration clause, to be decided with your lawyer.]
